1. ACCEPTANCE OF TERMS
By accessing, browsing, registering an account, or using the Ganevikkaa.com website ("Site"), you ("User," "you," "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Site. These Terms constitute a legally binding agreement between you and Ganevikkaa.com.
2. DEFINITIONS
- "Buyer" means a User who purchases or bids on items listed by a Seller.
- "Seller" means a User who lists items for sale or auction on the Site.
- "User Content" means all content, including listings, text, images, videos, and information, submitted to the Site.
- "Services" refers to all features, functions, and platforms provided by Ganevikkaa.com.
- "Account" means the unique user profile created upon registration.
3. ELIGIBILITY & ACCOUNT REGISTRATION
3.1 Age Restriction
You must be at least 18 years old to register an account and use the Site. By using the Site, you represent and warrant that you meet this age requirement.
3.2 Account Creation & Uniqueness
- You may register only one account per valid Maldivian mobile number.
- You must provide accurate, current, and complete information during registration and keep it updated.
- Accounts are for personal or business use only and may not be created for, or transferred to, another person without our express permission.
3.3 Account Security & Responsibility
- You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
- You must immediately notify us of any unauthorized use of your account or any other security breach.
3.4 Mobile Number Update Requirement
You must promptly update your registered mobile number in your account settings if it changes. If not updated:
- We reserve the right to disable the account or edit the mobile number field.
- The new owner of your old mobile number may gain access to your account, for which we shall not be liable.
3.5 Account Inactivity & Deletion
- Accounts may be deactivated upon user request but cannot be deleted to maintain transaction history and system integrity.
- We reserve the right to cancel accounts inactive (no login) for over five (5) years. After cancellation, your username may become available for new registration by others.
4. PERMITTED USE & LISTING POLICY
4.1 General Listing Principles
The Site provides a platform for users residing in the Maldives to list and sell products and services legally available for sale within the Maldives.
- You may only list items you legally own, have the right to sell, and have in your possession.
- Listings must be truthful, accurate, and not misleading in any way.
4.2 Specific Listing Requirements
- Categorization: Listings must be placed in the most appropriate category.
- Pricing: All prices must be listed in Maldivian Rufiyaa (MVR).
- Titles & Descriptions: Titles must be clear and free of unnecessary characters. Descriptions must accurately detail the item's condition, features, and flaws.
- Images: Photos must be of the actual item for sale, clear, relevant, and not contain unrelated images, watermarks from other sites, or contact information.
- Specificity: Listings in "For Sale" categories must be for specific items or item lots, not for general marketing (e.g., "laptops for sale" is prohibited; "Dell XPS 13 Laptop - 2023 Model" is acceptable).
- Intellectual Property: You must not infringe on any trademarks, copyrights, or intellectual property rights. Do not copy listing details from other users or third-party sites.
4.3 Prohibited Items & Activities
The following is a non-exhaustive list of strictly prohibited items and activities:
- Intoxicants: Alcoholic beverages, drugs, or any illegal substances.
- Tobacco & Vaping: Cigarettes, hookah, electronic cigarettes, and related accessories.
- Adult Content: Adult services, pornographic material, nudity, or obscene content.
- Regulated Goods: Prescription drugs, medical devices, or supplements with misleading health claims.
- Illegal & Infringing Goods: Stolen, counterfeit, pirated, or non-original goods labeled as original.
- Fraudulent Schemes: "Get-rich-quick," pyramid, "online money making," or referral marketing schemes.
- Financial Instruments: Currencies, cryptocurrency, or securities.
- Competitive Listings: Listings for other classifieds or online shopping sites. URLs or contact details promoting other platforms are forbidden.
- Offensive Content: Material that is defamatory, hateful, racially or religiously offensive, or violates Maldivian law.
- Brand Impersonation: Selling under a brand/trade name you do not own. Violations may result in account transfer to the rightful owner upon verified proof.
- Platform Abuse: Creating duplicate listings (same or different categories). Items may be re-listed no sooner than 5 days after deletion of the original. Submitting the same listings from multiple accounts is prohibited.
- Feedback Manipulation: Placing fake orders or feedback through related accounts to manipulate ratings or scores.
4.4 Username Policy
Usernames must not contain vulgar, abusive, offensive language, obscenity, profanity, another party's brand/trademark, or the word "ganevikkaa." We reserve the right to change inappropriate usernames.
5. USER CONTENT LICENSE & MODERATION
5.1 License Grant
By submitting User Content, you grant Ganevikkaa.com a worldwide, non-exclusive, royalty-free, sub-licensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the Site's operation and promotion.
5.2 Content Moderation Rights
We reserve the right, at our sole discretion, to:
- Reject, edit, modify, or remove any listing or User Content.
- Re-sequence images (e.g., to prevent inappropriate images from appearing as the primary photo).
- Remove YouTube videos or other embedded media if deemed irrelevant or inappropriate.
- Take any such action without prior notice and without liability to you.
6. AUCTIONS
6.1 Seller Obligations
By placing an item on auction, you agree:
- To sell it to the highest bidder if the bid meets or exceeds your Reserve Price.
- Not to sell the item outside the auction system before the auction closes.
- Not to withdraw the listing before the auction closes.
- Not to place bids on your own items (shill bidding), either directly or through others.
- Failure to honor a successful auction will result in a permanent ban from future auctions.
6.2 Bidder Obligations
By placing a bid, you agree:
- To purchase the item at your winning bid price if you are the highest bidder.
- That you have read, understood, and agree to the Seller's posted terms.
- That bids are binding and cannot be retracted.
- Failure to honor a winning bid will result in a permanent ban from future auctions.
7. FINANCIAL TRANSACTIONS & DISCLAIMERS
7.1 No Payment Processing
Ganevikkaa.com does NOT process payments, hold funds, escrow services, or offer buyer/seller protection programs. All financial transactions are conducted directly between Users.
7.2 User Responsibility for Transactions
- Buyers and Sellers are solely responsible for negotiating, agreeing upon, and fulfilling all terms of a sale, including price, payment method, delivery, condition, warranty, returns, and refunds.
- We strongly advise using secure, traceable payment methods and caution against wire transfers or advance payments without safeguards.
- Ganevikkaa.com is not a party to any transaction and assumes no liability for any fraudulent transactions, non-delivery, misrepresentation, or payment disputes.
8. USER DISPUTES & RESOLUTION
You are solely responsible for your interactions with other Users. While we are not obligated to mediate disputes, you may report fraudulent activity or serious policy violations through our reporting system. Our actions, which are discretionary, may include removing content, suspending accounts, or sharing information between disputing parties. We do not adjudicate claims or provide restitution.
9. LIMITATION OF LIABILITY & INDEMNIFICATION
9.1 Disclaimer of Warranties
THE SITE AND ITS SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GANEVIKKAA.COM, ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM:
- YOUR USE OF OR INABILITY TO USE THE SITE.
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY (INCLUDING OTHER USERS).
- ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT.
- ANY TRANSACTIONS BETWEEN USERS.
9.3 User Indemnification
You agree to indemnify, defend, and hold harmless Ganevikkaa.com and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including reasonable legal fees) arising from:
- Your use of and access to the Site.
- Your violation of any term of these Terms.
- Your violation of any third-party right, including intellectual property or privacy rights.
- Any claim that your User Content caused damage to a third party.
10. PRIVACY POLICY
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Site, you consent to the practices described in the Privacy Policy, which is incorporated into these Terms by reference.
11. LEGAL COOPERATION
We will cooperate fully with any law enforcement authorities, regulatory bodies, or court orders requesting or directing us to disclose the identity or information of anyone posting content or engaging in transactions in violation of the law. This includes providing user information (email, phone number, IP address, etc.) in cases of suspected illegal activity, such as the sale of stolen goods.
12. TERMINATION & SUSPENSION
We reserve the right to suspend or terminate your Account, disable your listings, or limit your access to the Site immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Site will cease immediately.
13. MODIFICATIONS TO THE TERMS
We may revise these Terms at any time at our sole discretion. The "Last Updated" date at the top will indicate when changes were made. Your continued use of the Site following the posting of revised Terms constitutes your acceptance of the changes. For material changes, we may provide additional notification via email or a banner on the Site.
14. GOVERNING LAW & DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the Republic of Maldives, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in Malé, Maldives.
15. MISCELLANEOUS
- Entire Agreement: These Terms constitute the entire agreement between you and Ganevikkaa.com regarding the Site.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
